Terms of Service

Diagnostics and Repairs

Ybarra Computer Services will attempt to diagnose your computer and/or other computer related equipment problem, provide an estimate of applicable service fees (plus parts if required), and then provide you with a repair solution. In certain cases, however, diagnosis and support may not be completed because of a problem with your computer or its configuration that is beyond our control.

Service Fees

You acknowledge that Ybarra Computer Services will provide free diagnostic testing of your computer or other computer related equipment only if you agree to complete the recommended service at the price quoted. In the event that you should decline quoted service, you agree to pay a service fee in the amount of $40.00 (on-site) or $30.00 (off-site). Once you provide verbal or electronic approval of the service fees, you agree to make payment for these fees upon completion of the service or if applicable upon pickup or delivery of your equipment.

Hardware Replacement

Any hardware used to repair your computer on site or in our shop are solely warranted by the hardware manufacturer and limited by the manufactures’ warranties. There are no expressed nor implied warranties by Ybarra Computer Services for any hardware that we replace.

Your Responsibility

While Ybarra Computer Services will make all reasonable efforts to safeguard the data stored on your computer, you understand and agree that prior to contacting or allowing Ybarra Computer Services to perform diagnostic, repair, or other services on your computer or equipment, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and/or data storage devices. Ybarra Computer Services cannot be held responsible for any storage device that has already failed or could be in a condition of imminent failure. You should understand that any or all data from such failed or failing data storage devices may not be recoverable. Further, some of the data recovered from failed or failing devices may be corrupted. Ybarra Computer Services will recover as much data as possible from such failed or failing data storage devices.

You acknowledge and agree that Ybarra Computer Services and/or its agents, subsidiaries, joint ventures, and employees shall not be responsible under any circumstance for any loss or corruption of data and/or software.

Limitations to Service

Ybarra Computer Services reserves the right to refrain from providing any or all requested serves and instead refund your payment, wholly or in part, on the basis that your technical needs or other requirements are unusual or extensive and beyond the scope of this service agreement as reasonably determined by Ybarra Computer Services.

Force Majeure

If Ybarra Computer Services’ ability to render repair service is impaired by you or circumstances beyond the control of Ybarra Computer Services, Ybarra Computer Services may choose not to provide or to discontinue services.

Complaints

If you are not satisfied with services received from Ybarra Computer Services, please call 915-542-0437 for an attempted resolution. Ybarra Computer Services is committed to customer satisfaction and will take the necessary steps to provide you with a fair, timely and effective means to resolve problems with any transaction.

Limitation of Liability

To the extent permitted by law, you agree that Ybarra Computer Services’ total liability for damages related to its services is limited to the total amount you pay for these services (plus parts if applicable), and you release Ybarra Computer Services from liability for any indirect, incidental, special, or consequential damages. Ybarra Computer Services is not liable for loss, alteration, or corruption of any data or for your inability to use your computer equipment or other product.
